It's "by the rules", but some ignore the similarity you're trying to highlight and fixate on random differences. That's their problem but it does open the way for (sometimes intentional) miscommunication.

However, it's important to remember that they are tools to explain what one means, not to argue/defend/support one's point.
There is great value in explaining one's position or through in detail and clearly, and sometimes repetitively, because many seeming disagreements are really merely mutual misunderstandings.
Of course, while both are needed, a more crucial aspect of avoiding misunderstanding and the false appearance of disagreement where there isn't actually any is in carefully listening and working hard to understand what the other person is saying (especially before expressing even the slightest disagreement), which is something we can all always do better at, myself included.
